Privacy Policy

This document explains how Mašek advokáti s.r.o. processes the personal data of website visitors, persons who contact us through the contact form, by e-mail or by telephone, and candidates applying for employment, cooperation or professional internship opportunities.

We process personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council, the General Data Protection Regulation, known as the GDPR, and Act No. 110/2019 Coll., on the Processing of Personal Data.

This Privacy Policy is available in Czech and English. In the event of any discrepancy between the Czech and English versions, the Czech version shall prevail.

2. What Personal Data We Process

We process only personal data that is necessary for the purposes described below.

If you contact us through the contact form, by e-mail, telephone, or otherwise, we may process in particular your first name and surname, e-mail address, telephone number, type of matter or area of enquiry, content of the message, data that you voluntarily provide to us in the course of communication, and technical data related to the submission of the form where necessary for website security and operation.

If you apply for employment, cooperation, or a professional internship, we may process in particular your first name and surname, contact details, CV, cover letter, information about education, qualifications, and professional experience, information contained in submitted attachments, and any other data that you voluntarily provide to us as part of the recruitment process.

Please do not send us special categories of personal data unless this is necessary for the purposes of the recruitment process. This includes, in particular, data concerning health, religious beliefs, political opinions, trade union membership, biometric data, or other sensitive information.

When visiting the website, technical data may also be processed, in particular the IP address, device type, browser type, operating system, approximate time of visit, information about behaviour on the website if we use analytical tools, and cookies or similar technologies.

3. Purposes for Which We Process Personal Data

We process personal data from the contact form, e-mails, or telephone communication for the purpose of handling your enquiry, responding to your message, arranging a consultation, or otherwise communicating with you.

If you contact us with a request for legal assistance, we may process personal data for the purpose of carrying out a basic assessment of your request, verifying whether we can take on the matter, and agreeing on next steps. The mere submission of a form or e-mail does not create an attorney-client relationship. Such a relationship is established only on the basis of an individual agreement.

We process candidates’ personal data for the purpose of assessing their application, conducting the recruitment process, communicating with the candidate, and potentially entering into an employment contract, agreement, or other cooperation contract.

We may also process personal data for the purpose of protecting our rights, legal claims, and legitimate interests, for example when handling disputes, security incidents, or proving legal facts.

We may process technical data and cookies for the purpose of ensuring website functionality, security, prevention of misuse, measuring traffic, and improving the user experience.

4. Legal Bases for Processing

We process personal data mainly on the basis of performance of a contract or steps prior to entering into a contract, typically when you contact us with a request for legal services or when you apply for employment or cooperation.

Another legal basis is our legitimate interest, in particular communication with persons who contact us, protection of our rights and legal claims, secure operation of the website, and basic management of our relationships with clients, prospective clients, and candidates.

We rely on consent especially where required by law or where the processing cannot be based on another legal basis. This may include, for example, retaining a candidate’s data for future recruitment processes or using certain analytical or marketing cookies. You may withdraw your consent at any time.

In some cases, we may process personal data because we are required to do so by law, for example in the areas of accounting, taxes, records, archiving, or obligations related to the practice of law.

5. Retention Periods

We retain personal data only for as long as necessary for the purposes for which it was processed, or for the period required by law.

We retain data from the contact form and general communication for the period necessary to handle the enquiry and subsequently for a reasonable period in case of follow-up communication or protection of legal claims. This is usually no longer than 3 years from the last communication, unless there is a reason for longer retention.

We process candidates’ data for the duration of the specific recruitment process. After the recruitment process ends, we retain the data for a reasonable period for the protection of legal claims, usually no longer than 6 months, unless applicable law or specific circumstances require a longer retention period. If you give us consent to include you in our candidate database for future recruitment processes, we may retain your data usually for no longer than 3 years or until you withdraw your consent.

If an agreement for the provision of legal services is concluded, personal data may be processed and retained in accordance with rules applicable to the provision of legal services, attorney files, accounting, taxes, and archiving.

The retention period for cookies and technical data depends on the type of cookies or technologies used. Details should be provided in the cookie settings or in a separate Cookie Policy.

6. To Whom We May Disclose Personal Data

We do not disclose personal data to third parties unless we have a legal reason to do so. Personal data may be made available in particular to the following categories of recipients:

  • persons involved in the operation of the law firm,
  • providers of IT, hosting, e-mail, and security services,
  • providers of website, analytics, or form tools,
  • accountants, tax advisors, or other professional advisors,
  • public authorities, courts, or other entities where such disclosure is required by law,
  • the Czech Bar Association, where this follows from legal regulations or professional rules.

Where required by law, we enter into appropriate data processing agreements with personal data processors.

7. Transfers of Personal Data Outside the European Union

We strive to process personal data primarily within the European Union or the European Economic Area.

If personal data is transferred outside the European Union or the European Economic Area in connection with the use of certain technical, hosting, analytical, or communication services, we will ensure that such transfer takes place in accordance with the GDPR, in particular on the basis of an adequacy decision, standard contractual clauses, or other appropriate safeguards.

8. Cookies

The website may use cookies and similar technologies. Cookies are small files stored on your device that may serve, for example, to ensure the basic functionality of the website, remember settings, measure traffic, or improve the user experience.

We use or may use in particular necessary cookies required for proper website operation, analytical cookies that help us understand traffic and website usage, and potentially marketing cookies if such tools are introduced in the future.

Access to personal data is limited to persons who need such access to perform their work or contractual duties and who are bound by confidentiality or an appropriate contractual obligation.

10. Automated Decision-Making and Profiling

We do not carry out automated individual decision-making, including profiling, that would have legal effects concerning you or similarly significantly affect you.

11. Your Rights

In connection with the processing of personal data, you have, under the conditions set out in the GDPR, in particular the following rights:

  • the right of access to personal data,
  • the right to rectification of inaccurate or incomplete data,
  • the right to erasure of personal data,
  • the right to restriction of processing,
  • the right to data portability,
  • the right to object to processing,
  • the right to withdraw consent where processing is based on consent,
  • the right to lodge a complaint with a supervisory authority.

You may exercise your rights by e-mail or in writing at the controller’s address. When handling your request, we may require reasonable verification of your identity in order to prevent unauthorised disclosure of personal data.

12. Right to Lodge a Complaint

If you believe that the processing of your personal data is not in accordance with applicable laws, you have the right to lodge a complaint with a supervisory authority. The supervisory authority in the Czech Republic is:

13. Processing of Data in Connection With Legal Services

If you become a client of the controller, your personal data may also be processed in connection with the provision of legal services, maintenance of attorney files, fulfilment of contractual and legal obligations, and protection of rights and legal claims.

Special rules arising from legal regulations and professional rules governing the legal profession may apply to the processing of personal data in connection with the provision of legal services, in particular the attorney’s duty of confidentiality.

We may update this document from time to time, in particular in connection with changes to the website, technologies used, legal regulations, or our internal processes.
